RIGHT TO REFUSE — OHSA ss.43-45
STEP 1
Have you identified an unsafe condition, work, or piece of equipment?
OHSA s.43(3): you may refuse work you have reason to believe is likely to endanger yourself or another worker.
STEP 2
Have you reported it to your supervisor and stayed in a safe place near your workstation?
OHSA s.43(3): tell the supervisor you are refusing and WHY. Stay in a safe place. You continue to be paid (s.43(7)).
STEP 3
Has the supervisor investigated WITH a JHSC worker rep (or another worker you chose) present, and the situation is still unsafe?
OHSA s.43(4): Stage 1 investigation must include the worker AND a worker-side JHSC member or another worker the refusing worker selects.
STEP 4
Have you continued the refusal in writing and called the Ministry of Labour (1-877-202-0008)?
OHSA s.43(6): if still unresolved, you may continue to refuse. Notify employer and JHSC. The MOL must be called to send an inspector.
STEP 5
Has a MOL inspector attended, investigated, and issued a written decision?
OHSA s.43(7): until the inspector decides, the employer cannot assign that work to another worker without informing them in writing of the refusal AND in the presence of a JHSC worker rep.
OHSA s.50 — REPRISAL PROTECTION: No employer may dismiss, discipline, intimidate, or threaten any worker for exercising rights under OHSA, including refusing unsafe work. Reprisal complaints go to the Ontario Labour Relations Board within 90 days.
